OPINION

Mr. Chief Justice Blume delivered the opinion of the court.

This is an action for specific performance of a contract brought by the plaintiff Ralph W. Flygare against the defendant Wallace M. Brundage on April 15, 1954. The parties will be referred to herein as in the court below.
