Plaintiff, a real estate broker, appeals from a judgment dismissing his suit for a commission.

Foulks, the real estate agent, was given a contract by the defendant Richardson as an exclusive agent to sell the latter's 120 acre Brock Farm for $18,500 of which $4,000 was to be a cash down payment, and further agreeing to pay Foulks $1,000 commission if the property was sold. This contract by its terms was to expire automatically without notice...
