SCHOTTKY, J.

Defendant above named was charged by information with the crime of violation of section 11500 of the Health and Safety Code, it being alleged that he "did willfully and unlawfully and feloniously have in his possession a preparation of Heroin." He pleaded not guilty, waived a trial by jury, and following trial the court found him guilty as charged. Probation was denied and judgment was pronounced. This appeal is from the judgment.
