YEAGER, Justice.

This is an action for damages for personal injuries, and hospital and medical expenses, by Clarence H. Benedict, plaintiff and appellee, against Andrew Andersen, defendant and appellant, on account of alleged negligence of the defendant.

The action was tried to a jury. A verdict was returned in favor of plaintiff for $11,109.80. Judgment was rendered on the verdict. Thereafter in due time an alternative motion for new trial or for judgment...
