SIMONS, Chief Judge.

The appellant was indicted on twelve counts for alleged violations of the Criminal Code, 18 U.S.C. § 912. His real name is Snipes but the indictment also listed him as parading under the alias A. C. Anderson. He was first tried to a jury on February 14, 1955. The jury found him not guilty under counts 11 and 12 and failed to agree on counts 1 through 10. He was re-tried on April 25, 1955, on the remaining counts, the jury finding him guilty...
