MCCLINTOCK, J.
This is an appeal on questions of law from a judgment of the Court of Common Pleas. The parties to this action shall be referred to as they were designated in the court below, to wit, Roy M. Dennis and Louise T. Dennis, plaintiffs, and Lester E. Hoffman, defendant.
Plaintiffs filed their second amended petition which in part reads as follows:
