BURNETT, Justice.

This is an appeal by the State from a judgment sustaining a plea of former jeopardy.

It appears from the record that the defendant in error had been indicted in the Criminal Court of Putnam County for the offense of obtaining money from the Thompson Manufacturing Company by false pretenses. It was alleged in the indictment that Malouf had entered into a verbal contract with the Thompson Company whereby he agreed to supervise certain construction...
