This action was instituted by Jessie Ryan Eicher against the New York Life Insurance Company, to recover on a life insurance policy issued by that Company insuring the life of her deceased husband, Welty A. Eicher, in her favor in the sum of $2,000. In its Answer and Grounds of Defense the Company denied liability on the ground that "the policy of insurance in question never became legally binding because of material misrepresentations and concealment...
