SMITH, J. (dissenting).

Upon complaint made July 1, 1954, defendant was arrested and charged with bastardy.* Examination was held before the justice of the peace on October 26, 1954, following which defendant was bound over to circuit court for trial. The case came on for jury trial on January 5, 1955, at which time defendant was found guilty. Motion for new trial was made in due course and denied. So much for the broad outlines...
