This is an appeal from an order overruling defendant's demurrer to plaintiff's petition. In the case below, W.H. Hammond, doing business as Hammond Ice Cream Company, was made a party defendant. He died prior to the trial court's ruling and revivor proceedings have not been had. Defendant Hartford Accident & Indemnity Company is sole appellant.
