Plaintiff Turner appeals from dismissal of his workmen's compensation suit against Southern Industries Company, a partnership. The District Court found no accident had been proved.

Plaintiff alleges disability by reason of hernia sustained while working for defendant. There is little doubt that at date of trial and from at least a few days after Turner's alleged accident, he was disabled by reason of hernia. The question is whether this hernia...
