The facts of the case are as follows: On July 5, 1954, plaintiff, Charles Fortier, 54 years of age, a lawyer living in Little Falls, Minnesota, left his home around ten o'clock in the evening and drove his car downtown to get a bowl of soup. As the restaurant that sold the soup was closed, he walked to the West Side Bar to see the owner thereof...
