TOMLINSON, Justice.

The jury found Odom guilty of murder in the first degree and fixed his punishment at confinement in the penitentiary for a period of ninety-nine years, sections 39-2404 and 39-2405 T.C.A. He moved for a new trial. After a hearing thereon, the Trial Judge entered judgment reducing the grade of the homicide to murder in the second degree, and fixed punishment at confinement in the penitentiary at "not less than ten nor more than twenty years".
