This is a suit against a corporation engaged in operating a hotel, hereinafter referred to as the defendant, and its house detective or officer, hereinafter called the officer, for assault and battery. At the conclusion of the evidence the defendant moved for a directed verdict, which motion I denied, having Rule 50(b), Fed.Rules Civ.Proc. 28 U.S.C.A. in mind, without consideration.
