This case is before the court on defendants' motion to dismiss under Rule 12(b), 28 U.S.C.A., said motion being based on two grounds: first, that the complaint fails to state a cause of action and, second, that the action is barred by the statute of limitations.

The amended complaint contains two alleged causes of action and each will be treated separately.
