This action is brought under sections 40 and 41 of the Civil Rights Law to recover money damages by way of a penalty because of alleged discrimination based upon plaintiff's claim that defendant refused to serve him in its dining room on August 12, 1956. Plaintiff, a colored man, claims discrimination because of race and color.
