Defendant was accused by information of the crime of breaking and entering in violation of section 708.8 of the 1954 Code, I.C. A., of Iowa. He pleaded not guilty. Upon trial to a jury he was found guilty "as charged in the information", and was sentenced to confinement in the penitentiary at Fort Madison, Iowa, for not more than ten years as provided by section 708.8 of the Code of Iowa, and ordered...
