This case is before us upon a writ of error granted Hampton Catlett, who challenges a final order entered on October 21, 1955, correcting nunc pro tunc an order which had been entered on June 18, 1953, in a prosecution against him under an indictment for rape.

On May 11, 1953, Catlett was indicted for rape by the Grand Jury of Fairfax County. He was arraigned and entered a plea of not guilty; whereupon the case was set for trial on...
