The appellant, John Robert Brower, and his wife, Phyllis Ann Brower, were charged in a single indictment with second degree murder of one Charles Preston Hagan. At the conclusion of the state's case in chief, the charge was dismissed against the wife. The jury at the conclusion of the trial returned a verdict of guilty of murder in the second degree as charged against the appellant, and that his age was 31 years. He was sentenced to life imprisonment...
