CONDON, Justice.

This is an indictment in which the defendant is charged with violating General Laws 1938, chapter 610, § 5. After a trial in the superior court, at which he presented no evidence in his own behalf, the jury returned a verdict of guilty. Therafter he moved for a new trial which was denied by the trial justice. The case is here on the defendant's bill of exceptions containing three exceptions, namely, to the denial of his motion to quash the indictment...
