This is an appeal in questions of law and fact from the Court of Common Pleas and is submitted upon a transcript of the testimony taken at the trial in the Court of Common Pleas and certain additional evidence taken by way of deposition.

Plaintiff's action, as set forth in her petition, is one to set aside a deed executed by her mother, Lydia E. Porter, on August 18, 1951, conveying part of inlot 317 of the city of Fostoria
