This action of trespass on the case for negligence was brought by the operator of a truck to recover damages for personal injuries resulting from a collision between the truck and a train at a railroad crossing. The action was tried in the superior court before a jury, and at the conclusion of the evidence for both plaintiff and defendant the trial justice granted the defendant's motion for a directed verdict.
