BUCHANAN, Justice.

The plaintiff, Elmer Jamison, brought this action for damages for injuries suffered by him when he attempted to alight from the back end of a standing truck and was struck by a car which ran into the rear of the truck. The suit was against Claude Richardson, operator of the truck, and Peery Richardson, the operator of the car. At the conclusion of the plaintiff's evidence the court struck it out as to Claude Richardson and the jury accordingly returned...
