Defendant was found guilty by a jury upon an amended information which accused him of a violation of section 288 of the Penal Code in that he did "wilfully and lewdly commit a lewd and lascivious act upon and with the body and certain parts and members thereof of George M. Buchel, a child under the age of fourteen years, to wit, of the age of thirteen years, with the intent of arousing, appealing to, and gratifying the lust, passion and sexual desires...
