This is an action under the Federal Employers' Liability Act, 45 U.S.C. A. § 51 et seq., in which the defendant moves for a new trial on the ground that the verdict of the jury was against the law, and excessive. While the amount is high, particularly in the light of positive evidence of contributory negligence by the plaintiff, I would not set it aside for that reason alone.
