CLEARY, Justice.

This is an action of tort seeking damages because of the insufficiency of the surety accepted on mesne process by the defendant officer. The cause was first tried by jury at the March, 1954 term of the Rutland county court, and resulted in a directed verdict and judgment for the defendant. This judgment was reversed by this Court, as reported in 118 Vt. 369, 111 A.2d 246....
