Purcell, pursuant to a conditional sales contract dated January 5, 1953, sold, and he thereupon delivered, to defendants Ray Spaulding and Earl Spaulding two trucks, trailers and numerous other items of personal property for a total consideration of $5,000 which defendants agreed to pay.
