An information was filed in the district court of Weld county in which it was charged that plaintiff in error, to whom we will hereinafter refer as defendant, on the 6th day of July, 1954, did "* * * wilfully and unlawfully kill and slay one Marlene Meyer * * *." Defendant entered a plea of not guilty, and upon trial a verdict of guilty was returned by the jury. Motion for a new trial was overruled, judgment entered and defendant sentenced to serve...
