In 1954 petitioner instituted an article 78 proceeding to review and annul a determination of the Commissioner of Motor Vehicles suspending his operator's license for 30 days. The proceeding was transferred for disposition to the Appellate Division. In March, 1955, the Appellate Division annulled the determination on the law and remitted the proceeding for further action to afford the commissioner...
