The plaintiff in error, Sam Pumpkin, defendant below, was charged by information in the District Court of Cherokee County, Oklahoma, with having committed the crime of murder on or about the sixth of March, 1955, with premeditated design, and did effect the death of one Jessie M. McLain, by means of a heavy blunt instrument with which he did strike Jessie McLain and inflict mortal wounds on the back of her head...
