This action is brought by the administratix of the estate of Walter Evans Bracher to recover increased retired pay claimed to have been due the decedent (hereinafter referred to as the plaintiff) under section 208 of the Naval Reserve Act of 1938, as amended by the act of August 10, 1946, 60 Stat. 993, 994, 34 U.S.C.A. § 854g.
