The defendants move to dismiss for insufficiency each of the two causes of action stated in the complaint, or in the alternative to strike certain allegations as irrelevant.

The first cause of action is brought under the Civil Rights Law (§§ 50, 51) for use of the plaintiff's name for purposes of trade and the second for libel; both are founded essentially on the same facts.<...
