This case is before the court under a special act, the text of which is set out in finding 1.

It authorizes the court to hear, determine and render judgment on a claim for damages to a Douglas DC-3 airplane owned by plaintiff on June 16, 1942, caused by a United States Army plane during a takeoff while the Douglas plane was lawfully parked at the John Rodgers Airport in the Territory of Hawaii.
