The principal question we are required to determine in this case, which is before us on certificate from the Court of Civil Appeals at Beaumont, is whether the allegations of the plaintiff's petition are "the best and all-sufficient evidence" that a defendant is a necessary party to the suit under Subdivision 29a of Art. 1995, Vernon's Ann.Tex.Civ.Stat.
