Moore, and appellee, Ray Hendricks, entered into a parole contract by which appellee agreed to assemble and deliver to appellant's place of business certain farm machinery and equipment. Appellee agreed that the machinery and equipment would be placed in merchantable and salable condition and that delivery would be made on or before February 20, 1953.
