This is the second time that the merits of this cause have been before this court.

On appeal from a writ of habeas corpus from the Circuit Court of Russell County, the Supreme Court of Alabama in Griggs v. Barnes, 257 Ala. 21, 57 So.2d 61, awarded the custody of the minor child, which is the subject of this suit, to his natural mother.
