The issues presented by this appeal flow as incidents from an action for divorce instituted by Jean W. Hardy, plaintiff and designated as an appellee in this court, against Philip S. Hardy, defendant and also designated as an appellee, which action was dismissed at the instance of plaintiff without a trial.
