The deceased above named died on or about the 26th day of October, 1948, as the result of injuries sustained by him through the alleged negligence of the State of New York, its officers and employees, while he was a patient at the Kings Park State Hospital, a hospital owned, maintained, and operated by the State of New York for the care and treatment of the mentally ill.
