Plaintiff brought this action for 10 per cent of the proceeds of the sale of all the capital stock of Ray Oil Burner Company, a California corporation, predicated upon the asserted exercise by plaintiff of an alleged oral option to purchase from defendant Ray Paoli* 10 per cent (25,000 shares) of the capital stock of that company.
