OPINION OF THE COURT BY STAINBACK, J.

The grand jury of the first judicial circuit on March 5, 1953, indicted defendant-plaintiff in error for malicious conversion.

On the evening of December 10, 1952, a certain motor vehicle, the property of one Kenneth Kaneshiro and Kameko Tamashiro, was unlawfully taken from a garage where it was parked.
