Plaintiff brings this action under the Federal Tort Claims Act, 28 U.S.C.A. § 1346, to establish the liability of the United States for personal injuries which he incurred when an airplane, flown by an employee of the United States at a height of approximately 100 feet over the farm where plaintiff was loading hay, caused plaintiff's horses to become frightened and to run away.
