The plaintiff, Mrs. Pauline Katz, sued John Wanamaker Philadelphia, Inc. in trespass to recover damages for injuries sustained as the result of a fall on a marble stairway in the defendant's store at 13th and Market Streets, Philadelphia. In her complaint plaintiff charged that her fall was due to defendant's negligence in permitting the stairway to remain in a "slippery, wet and slimy condition". The case was tried...
