This is an original action in habeas corpus brought by the petitioner, Charles Edwin York, to secure his release from confinement in the state penitentiary where he is serving a sentence of 45 years after conviction in the District Court of Oklahoma County on a charge of robbery with firearms. The appeal from such conviction has been affirmed by this court. York v. State, No. A-12,086, Okl.Cr.,
