This case is before the court on plaintiff's motion to strike a defense interposed by defendant and also on defendant's motion for summary judgment. Plaintiff, a veteran, instituted this suit to recover back pay alleged to be due him because of the failure of the General Services Administration to reemploy him in conformity with an order of restoration issued August 21, 1953, by the Civil Service Commission pursuant to section 14 of the Veterans...
