ADAMS, Justice.

The petitioner is the defendant in an action of trespass brought to recover damages to real estate by cutting timber and for other acts of the defendant. Upon trial the plaintiff prevailed and the case was brought to this Court on the defendant's exceptions where it is now pending. While so pending, the petitioner brings this petition for a new trial upon the ground of newly discovered evidence.
