This is a suit instituted by plaintiff Emanuel Francois for the rescission of a contract dated May 16, 1936, which purported to convey to defendant Horace R. Alexius three acres of land in the Parish of St. Tammany. The lower court sustained a plea of prescription of 10 years to plaintiff's action and dismissed his suit. From this judgment he has appealed to this court.
