Appellees W. E. Thompson and wife brought suit against E. W. Collingsworth, Jr., and Austin Road Company for damages for injuries sustained in a collision between an automobile driven by appellee Thompson and a gravel truck driven by Collingsworth. It was stipulated Collingsworth was, at the time, in the course of his employment with Austin Road Company.
