On October 1, 1953, an interlocutory decree was entered holding the claimant-respondent liable for damages sustained by the libelant's tank barge Hygrade No. 24 while in tow of the tug Choctaw. The claimant-respondent's tug Dynamic forced the barge against the bank of the New York State Barge Canal which resulted in this decree. This decree was affirmed by the Circuit Court.
