The defendant was charged with the crime of manslaughter (Pen. Code, § 192, subd. 1) in that on or about July 17, 1953, he did "wilfully, unlawfully and feloniously, without malice, kill one Otto Joseph Meyer, a human being." A jury returned a verdict of "Guilty of the crime of voluntary manslaughter as charged in the information." Defendant's motion for a new trial was denied and he was sentenced to imprisonment in the state's prison. He appeals...
