Plaintiffs brought this action to recover from the District Director of Internal Revenue income tax deficiencies which they claim were unlawfully assessed and collected for the years 1948 and 1949.

Plaintiffs, a husband and wife partnership, operated the Fields Chevrolet Company and, as such, were engaged in the sale of new and used cars and trucks.
